Online Trust Connect Terms and Conditions Agreement
Effective June 28, 2005

The Palmetto Heritage Bank & Trust Online Trust Connect Service is a free internet information service offered by the Trust Department of Palmetto Heritage Bank & Trust. By electronically submitting agreement and enrollment form, you agree to be bound by all its terms and conditions.

General Information: The Trust Connect System will allow you to view account information (balances and recent activity) for each account for which you have been granted access. Onscreen information cannot be altered or downloaded to other software.

NOTE: Account information is available through Trust Connect for inquiry purposes only. The system data is refreshed each Monday through Friday (exclusive of holidays) between 9:00 pm and 12:00 midnight. Asset prices are updated daily, with a few exceptions. While our ultimate goal is to completely automate the system, Palmetto Heritage Bank & Trust must manually change exception items. Every effort is made to provide current data, especially for a month end period, but, circumstances beyond the control of Palmetto Heritage Bank & Trust make it impossible to guarantee current data is always displayed on Trust Connect. Please verify you are reviewing current data.

Application: The Trust Connect System will be made available only to clients of Palmetto Heritage Bank & Trust currently receiving trust account statements. Upon approval of your Online Trust Connect Enrollment Form, the Trust Division will send written confirmation of your user access code and password ("LOGIN") used to access the System. You will be required to change your password immediately.

LOGINS can only be added, modified, or deleted by the Trust Division of the Bank. Your LOGIN is for your use only, and should never be given to any outside party. IF YOU FEEL YOUR LOGIN HAS BEEN COMPROMISED, YOU SHOULD NOTIFY THE TRUST DIVISION IMMEDIATELY.

After your application is approved, you may request additional parties be granted access to your accounts on the Trust Connect System. Upon approval of your written request by the Trust Connect System security, the Trust Division will send, under separate cover, LOGIN information to you for forwarding to each of the appropriate parties. No other individual will be granted authorization to access your accounts through the System.

Third Party Users: You agree to notify Palmetto Heritage Bank & Trust immediately should you choose to terminate a relationship with any of the individuals you have authorized to access your account using the Trust Connect System. Once notified, Palmetto Heritage Bank & Trust will revoke the individual's System privileges to your account. You further agree to indemnify and hold Palmetto Heritage Bank & Trust harmless from any and all claims of liability which may arise from such revocation.

Access: We will not be responsible for failure to provide access or for interruptions in access to Palmetto Heritage Bank & Trust's Online Trust Connect Service due to a system failure or due to other unforeseen acts or circumstances.

Your Computer Equipment or Software: We will not be responsible for any errors or failures from any malfunction of your computer or any computer virus or other problems related to your computer equipment used with Palmetto Heritage Bank & Trust's Online Trust Connect Service.

We are not responsible for any error, damages or other losses you may suffer due to the malfunction or misapplication of any system you use, including your browser (Microsoft Explorer®, Netscape Navigator®, or otherwise), your Internet Service Provider (ISP), your personal financial management or other software, (such as Quicken®, or Microsoft Money®), or any equipment you may use (including your telecommunications facilities, computer hardware and modem) to access or communicate with Palmetto Heritage Bank & Trust's Online Banking Service.

Electronic Notice: With your consent, we may send notices to you by electronic mail (e-mail). You may use e-mail to contact us about inquiries, maintenance, and/or some problem resolution issues. E-mail may not be a secure method of communication. We therefore recommend that you do not send confidential personal or financial information by e-mail. There may be times when you need to speak with someone immediately, especially to report a lost or stolen PIN. In these cases, do not use e-mail. Instead, call us at 843-237-7776, during regular business hours, Monday - Friday 9:00 a.m. - 5:00 p.m., excluding Bank Holidays.

Warranty and Software Limitations: NEITHER WE, NOR ANY OF OUR SUBSIDIARIES, ANY SOFTWARE SUPPLIER NOR ANY INFORMATION PROVIDERS MAKE ANY WARRANTY, EXPRESSED OR IMPLIED, TO YOU CONCERNING THE SOFTWARE, EQUIPMENT, BROWSER OR OTHER SERVICES INCLUDING, BUT NOT LIMITED TO, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR PARTICULAR PURPOSE (OR NON-INFRINGEMENT OF THIRD-PARTY RIGHTS), UNLESS DISCLAIMING SUCH WARRANTY IS PROHIBITED BY LAW.

Ownership of Website: The content, information and offerings on our Website are owned by Palmetto Heritage Bank & Trust, and the unauthorized use, reproduction, linking or distribution of any portions is strictly prohibited.

Geographic Restrictions: The Palmetto Heritage Bank & Trust Online Trust Connect services described in this Agreement and available on our Website are solely offered to citizens and residents of the United States of America currently residing in the United States. Citizens and residents outside the United States may not be able to access the Palmetto Heritage Bank & Trust Online Trust Connect Service.

Cancellation: If you wish to cancel any of your Palmetto Heritage Bank & Trust Online Trust Connect services, please contact Palmetto Heritage Bank & Trust's Trust Division at 843-237-7776 or send us cancellation instructions in writing to: Palmetto Heritage Bank & Trust-Online Banking Department, 10919 Ocean Highway, Pawleys Island, SC 29585.

Scope of Agreement: This Agreement represents our complete agreement with you relating to our provision of the Palmetto Heritage Bank & Trust Online Banking services. No other statement, oral or written, including language contained in our Website, unless otherwise noted, is part of this agreement.
Assignments: The Bank may assign certain of its rights and responsibilities under this Agreement to independent contractors or other third parties.
